Terms of Use

Effective

These terms apply to the WellHeard iPhone app and this website, provided by JLITECH LLC ("we", "us"). By downloading or using WellHeard you agree to them. If you do not agree, please do not use the app.

1. What WellHeard is

WellHeard is a personal tool for keeping a log of medical appointments for you and your family on your iPhone: notes, questions, follow-ups, attached documents, and recordings with their transcripts and translations.

2. Not medical advice, not a medical device

WellHeard does not provide medical advice, diagnosis or treatment, and it is not a medical device. It does not interpret, check or summarise what your clinician says. Always follow the advice of your healthcare professionals and contact them with any question about your care. In an emergency, call your local emergency number.

3. Transcripts and translations can be wrong

Transcripts and translations are produced automatically and will contain errors, including in medication names, doses, numbers and instructions. They are an aid to memory, not a replacement for the original recording or for your clinician's written instructions. Do not make decisions about your health based on a transcript or translation alone. Check the audio, and when in doubt, ask your care team.

4. Your responsibility to get consent

Laws on recording conversations differ between countries and states, and many require the consent of every person being recorded. Clinics and hospitals may also have their own rules. You are solely responsible for telling the people present, obtaining any consent that is required, and complying with the laws and rules that apply to you. Do not use WellHeard to record anyone secretly or unlawfully.

5. Your information

Your visits, recordings, transcripts, translations and attachments belong to you and stay on your device; see the Privacy Policy. You are responsible for keeping your iPhone secure, for backing up anything you want to keep, and for whom you share exports and recordings with. We cannot recover anything that is deleted or lost, because we never have a copy.

If you keep records for other people, such as your children or a parent, you are responsible for having the right to do so, for example as their parent or guardian or with their permission.

6. Free visit and subscription

You can add your first visit for free. Adding more requires a WellHeard subscription, which unlocks unlimited visits for you and the family members you add. Visits you have already saved remain available whether or not you subscribe. The price is shown in the app before you confirm.

The subscription lasts one year and renews automatically at the then-current price unless you turn off renewal at least 24 hours before the end of the year. Payment is charged to your Apple Account when you confirm the purchase and at each renewal. You can manage or cancel the subscription in your Apple Account settings; cancelling stops the next renewal, and you keep the subscription until the end of the year you paid for.

Subscriptions are sold through Apple's App Store and are subject to Apple's terms. Apple handles payment and refunds; to ask for a refund, use reportaproblem.apple.com. If you reinstall the app or change iPhone, use Restore purchase with the same Apple Account.

7. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use WellHeard on Apple devices that you own or control, as permitted by the App Store's usage rules. Unless we say otherwise, the app is licensed under Apple's standard Licensed Application End User License Agreement, and these terms add to it. You may not copy, resell, reverse engineer or modify the app except where the law allows it.

8. Acceptable use

You agree not to use WellHeard to break the law, to infringe anyone's privacy or other rights, or to harass or harm another person.

9. Availability and changes

WellHeard depends on features of iOS, including Apple's on-device speech recognition and translation. The languages and devices supported are determined by Apple and can change. We may update, change or stop offering the app at any time.

10. Disclaimer of warranties

To the fullest extent permitted by law, WellHeard is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that a recording will be captured completely, that transcripts or translations will be accurate, or that the app will be free of errors or interruptions.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of or inability to use WellHeard, including any reliance on a transcript or translation. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim, or USD 50 if greater. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law of the place where you live.

12. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the fullest extent permitted by law, Apple has no other warranty obligation with respect to the app. We, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country under a US Government embargo and are not on any US Government list of prohibited or restricted parties.

13. Changes to these terms

We may update these terms from time to time. We will post the new version here and change the effective date. Continuing to use WellHeard after an update means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the country where we are established, without regard to conflict-of-law rules, and subject to any mandatory consumer protections where you live.
